Le mois dernier, la nation indienne Seneca a finalement r\u00e9solu son diff\u00e9rend avec l'\u00c9tat de New York et a accept\u00e9 de n\u00e9gocier un nouvel accord avec l'\u00c9tat de l'Empire. Cependant, ce mardi, un groupe de femmes Seneca, les M\u00e8res de la Nation, s'est rassembl\u00e9 sur le territoire d'Allegany pour exprimer son opposition au r\u00e9cent accord entre le pr\u00e9sident de la Nation, Matthew Pagels, et l'\u00c9tat.<\/p>\n

Il y a quelques ann\u00e9es, la tribu a refus\u00e9 d'effectuer ses paiements \u00e0 l'\u00c9tat de New York, au motif que l'accord renouvel\u00e9 ne pr\u00e9cisait pas si la nation devait continuer \u00e0 le faire. Toutefois, le mois dernier, la tribu s'est engag\u00e9e \u00e0 verser 140 millions de dollars am\u00e9ricains de paiements contest\u00e9s, ce qui a permis de r\u00e9soudre le probl\u00e8me. M. Pagels a d\u00e9clar\u00e9 que la nation \u00e9tait \u00e9galement pr\u00eate \u00e0 n\u00e9gocier un nouveau contrat.<\/p>\n

Remise en question de la l\u00e9galit\u00e9 des paiements\"\"<\/h2>\n

Les M\u00e8res de la Nation demandent instamment au Conseil tribal de ne pas verser \u00e0 l'Empire State les $800 millions de dollars de paiements contest\u00e9s. Le groupe, qui est reconnu par la constitution Seneca des trait\u00e9s de 1848, a lanc\u00e9 une p\u00e9tition<\/strong> afin de recueillir les signatures des femmes Seneca qui consid\u00e8rent que l'accord de r\u00e8glement n'est pas valable. La p\u00e9tition a \u00e9t\u00e9 d\u00e9pos\u00e9e aupr\u00e8s du minist\u00e8re de l'int\u00e9rieur.<\/p>\n

Le groupe demande au pr\u00e9sident Pagels d'interrompre les paiements, car le combat ne sera pas termin\u00e9 tant que tous les recours f\u00e9d\u00e9raux n'auront pas \u00e9t\u00e9 \u00e9puis\u00e9s. Les M\u00e8res affirment que le total des sommes impay\u00e9es s'\u00e9l\u00e8vera \u00e0 autour de US$800<\/strong> millions d'euros d'ici \u00e0 2023. Le groupe d\u00e9clare \u00e9galement que l'accord de r\u00e8glement et les d\u00e9penses sont des actions qui n\u00e9cessitent l'approbation du Conseil en vertu de la Constitution de la Nation pour \u00eatre valides.<\/p>\n

Marie E. Williams, ancienne directrice ex\u00e9cutive de la Seneca Gaming Authority, a d\u00e9clar\u00e9 que M. Pagels a a viol\u00e9 les protocoles l\u00e9gislatifs<\/strong> en ne donnant pas l'autorisation du conseil concernant le nouvel accord avec New York. Selon elle, le pr\u00e9sident de la nation a agi sans l'autorisation du conseil et sans le consentement \u00e9clair\u00e9 du peuple.<\/p>\n

Jody Clark, signataire de la p\u00e9tition des M\u00e8res de la Nation et r\u00e9sidente de la r\u00e9gion d'Allegany, a d\u00e9clar\u00e9 qu'il fallait une d\u00e9termination f\u00e9d\u00e9rale et du NIGC. Selon elle, le pr\u00e9sident a n'a pas tenu compte de l'examen en cours de la NIGC<\/strong> de la l\u00e9galit\u00e9 des paiements et a conclu un accord avant de proc\u00e9der \u00e0 un examen f\u00e9d\u00e9ral complet. Elle a qualifi\u00e9 ses actions de myopes et pr\u00e9matur\u00e9es.<\/p>\n

Plus d'opposition<\/h2>\n

Peu apr\u00e8s l'annonce par M. Pagels de la r\u00e9solution du diff\u00e9rend qui l'opposait depuis un an \u00e0 l'\u00c9tat de New York, Susan Abrams a d\u00e9pos\u00e9 une demande d'asile aupr\u00e8s de la Commission europ\u00e9enne. proc\u00e8s<\/a> au sein de la tribu Cour du pacificateur<\/strong>. Elle a ajout\u00e9 qu'elle s'attendait \u00e0 ce que le tribunal rende une d\u00e9cision \u00e9quitable sur sa demande d'ordonnance restrictive temporaire contre les paiements. La tribu a refus\u00e9 de commenter l'affaire \u00e0 l'\u00e9poque.<\/p>\n

Le mois dernier, le juge de district am\u00e9ricain William M. Le juge a d\u00e9clar\u00e9 que la tribu doit honorer ses paiements<\/strong>, L'\u00c9tat attend les paiements depuis plus de cinq ans, et la nation ne sera pas confront\u00e9e \u00e0 des difficult\u00e9s extr\u00eames et excessives si la Cour ne renverse pas sa d\u00e9cision pr\u00e9c\u00e9dente.<\/p>\n
